(1) Use of This Website
(1.2) The term ‘Larosacouture’ or ‘us’ or ‘we’ refers to the owner of the website. The term ‘you’ refers to the user or viewer of our website.
(1.4) The content of the pages of this website is for your general information and use only. It is subject to change without notice.
(1.5) While every effort is made to ensure the accuracy of information on this website we cannot guarantee the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. We expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
(1.6) This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
(1.7) All trade marks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
(1.8) From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
(1.9) Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.
(2) Terms of Sale
(2.1) We may revise these Terms as they apply to your order from time to time to reflect changes in laws and new regulatory requirements.
(3) Placing Orders
(3.1) By paying for goods you are entering into a contract with Larosacouture and are bound by our terms of sale. The contract starts when you receive the ‘Despatch Confirmation’ order. You can cancel the order anytime before receiving this confirmation. If you have received this conformation and wish to cancel your order please see section 4 – Returns and Cancelling an Order.
(3.2) All orders are subject to acceptance and availability. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the order.
(3.3) After you place an order, you will receive an order confirmation email from us acknowledging that we have received your order. This email is not an acceptance of your order, just a confirmation that we have received your order.
(3.4) We will confirm our acceptance of your order to you by sending you an email that confirms that the items have been dispatched (“Dispatch Confirmation”). The contract between us will only be formed when we send you the Dispatch Confirmation. Only items dispatched will be included in the contract.
(3.6) When placing your order we carry out a standard pre-authorisation check on your payment card. Payment will not be taken until your order has been accepted and a Dispatch Confirmation been sent. The only exception is a telephone sale which is charged at point of purchase. These funds will not be available for your use. The hold will stay on your card until payment of the goods is processed on dispatch of your order. If you cancel your order prior to dispatch we will release the hold. Please note that your bank may take up to 30 days to release the pre authorised funds.
(3.7) We may choose not to accept your order in our discretion for any reason whatsoever without liability to you. We will inform you if we choose not to accept your order by email and we will not process your order. If you have already made a payment we will refund you the full amount as soon as possible.
(3.8) We cannot be held responsible for the non-arrival of goods, due to incorrect or incomplete details being submitted at the time of ordering.
(3.9) You have 14 days from the date you receive the last item of your order to cancel. In the event of you cancelling your order please contact firstname.lastname@example.org who will arrange your return via a RMA
(3.10) The prices of the items will be as quoted on our site at the time you submit your order. We take all reasonable care to ensure that the prices of items are correct at the time when the relevant information was entered onto the system.
(3.11) For orders placed within the EU, all prices shown include the applicable VAT. If your order is being delivered outside of the EU (which includes the Channel Islands), VAT will not be charged, however the selling price will remain the same. If the rate of any applicable VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the items in full before the change in VAT takes effect.
(3.12) The price of an item does not include delivery charges unless stated. Our delivery charges are as advised to you during the check-out process, before you confirm your order.
(4) Returns and Cancelling an Order
(4.1) You have 14 days from the date you receive the last item of your order to cancel. In the event of you cancelling your order please contact customer services email@example.com who will issue you with a RMA.
If an item has been delivered to you before you decide to cancel your contract:
(a) then you must return it to us not later than 14 days after the day on which you let us know that you wish to cancel the contract. We may withhold reimbursement until we have received the items back.
(b) unless the item is faulty or not as described you will be responsible for the cost of returning the item to us.
(4.2) If you wish to return an item to us, please contact customer services to obtain a returns number (RMA). Be sure to include the RMA number so there’s no delay in processing your return. Please return the item to us in its original condition.
(4.3) When returning an item, it is your responsibility to ensure that the correct postage is paid and the goods are correctly packaged. We recommend a tracked postal service is used. Larosacouture can accept no responsibility for items lost in transit.
(4.4) We cannot issue pre-paid shipping labels for returns, but if you are returning an item as faulty and that is found to be faulty we will refund additional shipping costs. In this event please include a postage receipt.
(4.5) If you believe an item is faulty and under warranty please contact us at Larosacouture to obtain a Returns Authorisation. We cannot accept an item as faulty until it is returned to us and it has been inspected. In the event of an item being faulty we will either refund, exchange replace or repair the item according to the nature of the fault and after contacting you.
If you cancel your contract we will:
(4.6) refund you the price you paid for the items. Please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop or which is beyond what is necessary to establish the nature characteristic and functioning of the items.
· Please take reasonable care when opening original packaging and, where possible, ensure it is returned along with the item(s).
· All items should be inspected and tried on with reasonable care being exercised.
· Items should be returned unused and in a resalable condition, with all garment tags and care labels still attached. If returned items are damaged or soiled we may not accept them and may send them back to you and/or refuse a refund.
(4.7) refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer (provided that this is a common and generally acceptable method). For example, if we offer delivery of an item at one price or for free but you choose to have the item delivered the next day or on a Saturday at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.
(4.8) make any refunds due to you without undue delay and in any event within the following timescales:
· if you have received the item, 14 days after the day on which we receive the item back from you or, if earlier, the day on which you provide us with evidence that you have sent the item back to us.
· if you have not received the item, 14 days after you inform us of your decision to cancel the contract.
(4.9) If you have returned the items to us because they are faulty or mis-described, we will refund the price of the items in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us. However please note we cannot accept liability for an item as faulty until it has been returned to us and we have had an opportunity to inspect it and confirm that it is faulty.
(4.10) We will refund you on the original method of payment.
(5) Shipping Terms and Delivery Charges
(5.1) Standard delivery orders are usually shipped within 24 hours although we aim to ship the same day if you order before 3pm. After bank holidays some orders may take a little longer to dispatch. Please email us if your order is urgent.
(5.2) On occasion, for fraud and theft prevention, it is necessary to look further into an order’s details, which may include address and cardholder ID checks. This can delay the shipping of an order.
(5.4) Orders placed after 3pm on Friday and through the weekend (including Bank Holidays) will be dispatched the next working day. At certain times of year when the postal system is busier, orders may take a little longer to arrive and we ask that you wait an additional 3 post days (Mon-Sat), before contacting us.
(5.5) Items sent by a tracked service such as Special Delivery, Courier Delivery or Worldwide, will require a signature on receipt. It is your responsibility to ensure that someone is available to sign for your order.
(5.6) If your order hasn’t arrived, you must notify us within 21 days from the date of your order for us to consider it missing.
For deliveries outside the EU:
(5.10) You will be responsible for payment of any customs clearance expenses, import duties, sales taxes, brokerage fees and any other similar charges or fees imposed by the customs authorities of the destination country. Payment of these will be necessary in order to release your items from customs on arrival. Please note that we have no control over these charges and cannot predict their amount or offer a refund in the event that you are unable or unwilling to pay these charges.
(5.11) You are responsible for providing any information required by the customs authorities of the destination country to ensure the items are cleared. We recommend you contact the customs authorities of the destination country to determine a landed cost price for the items prior to placing an order and what information will be required to obtain release of the items from customs.
(6) Price of items
(6.1) The prices of the items will be as quoted on our site at the time you submit your order. We take all reasonable care to ensure that the prices of items are correct at the time when the relevant information was entered onto the system.
(6.2) For orders placed within the EU, all prices shown include the applicable VAT. (6.4) It is always possible that, despite our best efforts, some of the items on our site may be incorrectly priced.
(a) where the item’s correct price is less than the price stated on our site, we do not have to provide the item to you at the incorrect (lower) price;
(b) if the item’s correct price is higher than the price stated on our site, we will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the item at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.
(6.7) Unfortunately, we cannot advise you in advance of any proposed reduction in prices or reimburse you the difference in the event that an item you order is subsequently reduced in price.
(6.8) We may from time to time run special promotions or issue promotional codes. Unless otherwise expressly stated on the specific promotion, promotional codes cannot be used in conjunction with any other offer or promotion. We reserve the right to change or terminate any promotion without notice at any time.
(7.1) We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below.
(7.2) An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, adverse weather conditions, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(7.3) If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:
· we will contact you as soon as reasonably possible to notify you; and
· our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of items to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
(7.4) You may cancel a contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant items you have already received and we will refund the price you have paid, including any delivery charges.
(8.1) We cannot accept liability for an item as faulty until it has been returned to us and we have had an opportunity to inspect it and confirm that it is faulty.
(8.2) If goods are found to be faulty you are entitled to a full refund up 30 days after the item was purchased. We will refund the price in full, together with any applicable return delivery costs. In this event please provide a return postage receipt.
(8.3) If goods prove faulty up to 6 months after purchase we will offer a repair or a replacement. In the event they can’t be repaired or replaced, you are entitled to a full refund.
(8.4) Please note the life expectancy of a product depends on the individual using it; their characteristic wear pattern and the conditions in which it’s used. Products damaged by normal wear and tear, negligence or products that have exceeded their reasonable lifespan, will not be not replaced.
